Reso 0068-09/1958 RESOLUTION NO. 68 RESOLUTION OF THE BOARD OF DIRECTORS OF SAN MARCOS COUNTY WATER DISTRICT ORDERING, CALLING, PROVIDING FOR, AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN IM- PROVEMENT DISTRICT NO. 2 OF SAID COUNTY WATER DISTRICT ON TUESDAY, SEPTEMBER 30, 1958, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID IMPROVEMENT DIS- TRICT A PROPOSITION TO INCUR BONDED IN- DEBTEDNESS BY SAID COUNTY WATER DISTRICT FOR A CERTAIN DISTRICT IMPROVEMENT. The Board of Directors of San Marcos County Water District does hereby RESOLVE, DETERMINE AND ORDER as follows: Section 1. That this Board deems it necessary that the San Marcos County Water District incur a bonded indebted- ness in the principal amount of two hundred fifty thousand dollars ($250,000) for the purpose of the acquisition and construction of additional trunk sewers and appurtenances and appurtenant work, including the acquisition of the nec- essary land, easements, rights of way, works, machinery and other property, together with all necessary engineering and legal services in connection therewith. Section 2. That, following a hearing thereon as by law provided, this Board has determined, and does hereby determine and state, that only a portion of said county water district will be benefited by the accomplishment of the pur- pose stated and by incurring said bonded indebtedness, which portion so benefited constitutes and is known as "Improve- ment District No. 2 of San Marcos County Water Districtt! and is that portion of said San Marcos County Water District lying within an exterior boundary line described as follows: PARCEL No. 1 Those portions of Sections 19, 30 and 29, all in Township 12 South, Range 3 West, S.B.B.& M., in the County of San Diego, State of California, according to United States Government Survey thereof, described as follows: Beginning at the Southeast corner of said Section 29; 1. Thence Westerly along the South line of said Section 29 to the Southwest corner of the Southeast Quarter thereof; 2. Thence Northerly along the North-South center line of said Section 29 to the South line of the North Half of the Southwest Quarter of said Section 29; 3. That the amount of bonded indebtedness proposed to be incurred for said purpose is two hundred fifty thousand dollars ($250,000); that thè maximum term the bonds to be issued shall run before maturity shall be the maximum term permitted by law, to wit: forty (40) years from the date thereof, but said bonds may be made to mature within a lesser number of years; that the maximum rate of interest to be paid on said indebtedness shall not exceed the maximum rate per- mitted by law, to wit, seven per cent (7%) per annum, payable annuallY,for the first year and semiannually thereafter, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. Section 4. That a special election be held, and the same is hereby called to be held in said Improvement Dis- trict No. 2 of San Marcos County Water District on the 30th day of September, 1958, for the purpose of submitting to the qualified voters of said district the proposition of incurring the said indebtedness and issuing bonds of said county water district therefor, in the amount hereinabove set forth, and for the purpose hereinabove stated. That if the proposition. for the incurring of said indebtedness so submitted receives the requisite number of votes, to wit, more than two thirds of the votes of the qualified voters voting on said proposition, bonds óf said county water district in not exceeding the principal amount hereinabove set forth shall be issued and sold for the purpose hereinabove set forth. Said bonds will be bonds of San Marcos County Waýer District, but any taxes levied to pay the prin- cipal and interest of said bonds will be levied only upon the 11. taxable property within that portion of said district which constitutes said Improvement District No. 2 of San Marcos County Water District, all as provided in the County Water District Law. Section 5. That the polls for said election shall be opened at seven o'clock A.M., of the day of said election and shall remain open continuously from said tìme until seven o'clock P.M. of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. Section 6. All marks otherwise made are forbidden. All distinguishing marks are for- bidden and make the ballot void. Section 7. A cross (+) placed in the voting square after the word ttYES" in the manner hereinbefore provided shall be counted in favor of the adoption of the question or prop- osition. A cross (+) placed in the voting square after the word :lNOH in the manner hereinbefore provided shall be counted against the adoption of the question or proposition. Section 8. That for the purpose of holding said special election all of the territory within said Improvement District No. 2 of San Marcos County Water District shall com- prise one voting precinct which shall be designated Consoli- dated Voting Precinct No. l. Said Voting Precinct No. 1 shall consist of those portions of regular election precincts San Marcos 1, 2, Vista 3l and 32 lying within the boundaries of Improvement District No. 2 of the San Marcos County Water District. The polling place for said precinct shall be the place hereinafter designated, and the persons hereinafter named, being competent and qualified electors and residents of said county water district and of said election precinct, are hereby appointed officers of election and they shall hold said election and make return thereof in the manner provided by law: Polling Place: San Marcos Community Church Social Hall, n/w corner of Encinitas Road and San Marcos Avenue. Section lO. That the Board of Directors of said district shall meet at its usual place of meeting on Monday, October 6, 1958, at 7:30 o'clock P.M. of said day, and pro- ceed to canvass the election returns. Section ll. That, there being no newspaper printed and published in said district, notice of said election shall be given by the Secretary of this Board of Directors, in the form and manner provided by law, by posting a Notice of Elec- tion in three (3) public places in said district.
