RESOLUTION OF THE BOARD OF DIRECTORS
OF SAN MARCOS COUNTY WATER DISTRICT
MAKING DETERMINATIONS RELATING TO A
CERTAIN DISTRICT IMPROVEMENT.
WFEREAS, on March 7, 1960, this Board of
Directors adopted its resolution determining that this
Board deems it necessary for the San Marcos County Water
District to incur a bonded indebtedness in the sum of
six hundred thousand dollars ($600,000) for the purpose
of the acquisition and construction of additional trunk
sewers and appurtenant work, including the acquisition
of all land, easements, rights of way, pipe, valves,
machinery and other property necessary for any of the
foregoing together with all necessary engineering and
legal services in connection therewith; and
WEREAS, in said resolution this Board fixed
April 4, 1960, at 7:30 o'clock, P.M. at the office of
the San Marcos County Water District, Encinitas Road, near
Bent Avenue, San Marcos, San Diego County, California, as
the time and place for the hearing by this Board on the
questions: will the whole or only a portion of the dis-
trict be benefited by the accomplishment of said purpose,
and, if only a portion of the district will be benefited,
,at portion will be so benefited; and
WHEREAS, at said hearing evidence was presented
to the Board on the said questions before it, and this Board
is fully advised in the premises;
NOW, THEREFORE, the Board of Directors of the
San Marcos County Water District does hereby RESOLVE,
DETERMINE AND ORDER as follows:
Section 1. That as a result of said hearing
and upon the said evidence presented, this Board does
hereby determine that the whole of said district will
not be benefited by the accomplishment of said purpose,
and that only a portion of said district will be benefited
by the accomplishment of said purpose, which portion so
benefited is determined to be the portion of said district
lying within an exterior boundary line described as
follows:
Section 2. That the portion of said San Marcos
County Water District described in Section 1 hereof shall
hereupon constitute and be known as "Improvement District
No. 5 of San Marcos County Water District."
