A RESOLUTION OF THE BOARD OF DIRECTORS OF SAN MARCOS
COUNTY WATER DISTRICT, AUTHORIZING AND DIRECTING THE
CONDEMNATION OF CERTAIN REAL PROPERTY SITUATED IN THE
COUNTY OF SAN DIEGO, STATE OF CALIFORNIA
BE IT RESOLVED by the Board of Directors of SAN MARCOS COUNTY
WATER DISTRICT, as follows:
Section 1: That the public interest, convenience and neces-
sity of SAN MARCOS COUNTY WATER DISTRICT a state agency of the
State of California, and the inhabitants thereof, require the
construction operation and maintenance of facilities for the
transmission and distribution of water and of water pipelines,
facilities and appurtenances upon certain lands in the County of
San Diego, State of California, hereinafter more particularly de-
scribed.
Section 2. That the public interest, convenience and neces-
sity of the above named County Water District and to its inhabitants
demand the acquisition and taking of said lands for the construction,
operation and maintenance of facilities for the transmission and dis-
tribution of water and of water pip, lines, facilities and appurtenances.
Section 3. That the property over which rights of way are to
be taken by said County Water District, hereinabove referred to, is
in the County of San Diego, State of California, and is described as
follows:
All that portion of the Northwest Quarter of the Northeast
Quarter of Section 8, Township 11 South, Range 3 West, San
Bernardino Meridian, in the County of San Diego, State of
California according to United States Government Survey
approved December 14, 1885, described as follows:
Beginning at a point in the South line of said Northwest
Quarter of the Northeast Quarter which is distant thereon
North 89'46' 16" West 1014.62 feet from the Southeast corner
thereof; thence North 0°13'44" East 330.00 feet; thence South
89o46 ' 16" East 477.59 feet; thence North 16"46 ' 16" West
433.51 feet; thence North 41'01' West356.67 feet; thence North
8e52 ' 20" West 116.50 feet; thence North 8t'07 ' 40" East 170.00
feet; thence South 87°15'35'' East 345.54 feet to the TRUE
POINT OF BEGINNING; thence South 52'17'38" East 170.00 feet;
thence North 82'09'42" East 275.00 feet to the East line of
the Northwest Quarter of the Northeast Quarter of said Section
8; thence along said East line North 0°22'34'' East 257.02
feet to the Northeast corner of said Northwest Quarter of the
Northeast Quarter; thence along the North line of said North-
west Quarter of the Northeast Quarter North 89°43'30" West
323.71 feet to a line which bears North 23°50'54'' East from
the TRUE POINT OF BEGINNING; thence along said line South
23°50'54" West 210.00 feet to the TRUE POINT OF BEGINNING.

An easement and right-of-way, 20 feet wide, the center line
of which is more particulary described as follows:
The North 20 feet of the above described property.
Section 4. That immediate possession shall be taken of the
rights of way described in Section 3 hereof.
Section 5. That the taking and acquiring by said County Water
District of the rights of way herein described is deemed to be nec-
essary for the construction, operation and maintenace of facilities
for the transmission and distribution of water and of water pipe-
lines, facilities and appurtenances. That such use is a public use
and that for such public use it is necessary that said County Water
District condemn and acquire said rights-of-way.
Section 6. That the law firm of POWELL & MARTINSON, 365
Broadway, Vista, California, be and they are hereby authorized and
directed to commence an action in the Superior Court of the State
of California, in and for the County of San Diego, in the name of
and on behalf of the SAM MARCOS COUNTY WATER DISTRICT against all
owners and claimants of the above described right-of-way for the
purpose of condemning and acquiring said right-of-way for the use
of said SAN MARCOS COUNTY WATER DISTRICT; that said condemnation
action shall be prosecuted in accordance with the provisions of the
law applicable thereto.
