RESOLUTION OF THE BOARD OF DIRECTORS OF THE
SAN MARCOS COUNTY WATER DISTRICT FAVORING THE
PRINCIPLE, SUBSTANCE AND FORM OF THE "FOURTH
SUPPLEMENT TO BASIC AGREEMENT BETWEEN VISTA
SANITATION DISTRICT AND THE CITY OF CARLSBAD
FOR ACQUISITION AND CONSTRUCTION OF THE JOINT
SEWER SYSTEM" WHICH PROVIDES FOR PARTICIPATION
BY SAN MARCOS COUNTY WATER DISTRICT IN THE
CARLSBAD, VISTA, BUENA-JOINT SEWER SYSTEM
BE IT HEREBY RESOLVED THAT WHEREAS: The Board of Directors of the San
Marcos County Water District has expressed an interest in participating in
joint sewage treatment and ocean outfall disposal facilities being constructed
~y the City of Carlsbad, Vista Sanitation District, and the Buena Sanitation
District;
BE IT FURTHER RESOLVED the San Marcos County Water District has received
and reviewed a draft agreement prepared by engineers and counsel for Carlshad,
Vista and Buena entitled "Fourth Supplement to Basic Agreement Between Vista
Sanitation District and the City of Carlshad for Acquisition and Construction
of the Joint Sewer System" which provides for participation by San Marcos
County Water District in the aforesaid treatment and disposal facilities;
NOW, THEREFORE, BE IT RESOLVED that in consideration of the premises
~nd mutual covenants and agreements contained in the Fourth Supplemental
Agreement, San Marcos County Water District determines that it favorably
considers in Principle, Substance and Form the aforesaid Fourth Supplemental
Agreement and further resolves to effect the consumation of this agreement
upon the consistent resolve of the governing bodies of Carlshad, vista and
Buena.
