RESOLUTION OF THE BOARD OF DIRECTORS OF THE
SAN MARCOS COUNTY WATER DISTRICT AUTHORIZING
THE EXECUTION OF A STIPULATION VACATING FINAL
ORDER OF CONDEMNATION AND FOR ENTRY OF COR-
RECTED ORDER OF CONDEMNATION NUNC PRO TUNC IN
THAT CERTAIN CASE PENDING IN THE SUPERIOR
COURT, STATE OF CALIFORNIA, IN AND FOR THE
COUNTY OF SAN DIEGO, NO. 253843.
WHEREAS, the San Marcos County Water District has hereto-
fore filed an action in condemnation against the Investlands Com-
pany, and others, in that certain case no. 253843, pending in the
Superior Court, State of California, in and for the County of San
Diego, and
WHEREAS, a final order of condemnation was entered in said
lawsuit in favor of the San Marcos County Water District, and
WHEREAS, it is necessary that the final order of condemna-
tion entered in the above entitled case be vacated and a corrected
order of condemnation and corrected final order of condemnation be
entered Nunc Pro Tunc.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors of
the San Marcos County Water District as follows:
Section 1. That the President of the Board of Directors is
hereby authorized and directed to execute that certain stipulation
vacating final order of condemnation and for entry of corrected
order of condemnation, Nunc Pro Tunc, in the Superior Court of the
State of California, in and for the County of San Diego, Action No.
253843, a copy of said stipulation is attached to this Resolution.
Section 2. That the attorney for the San Marcos County Water
District is hereby authorized and directed to execute, on behalf of
the San Marcos County Water District, the stipulation described in
Paragraph 1 above.

regular meeting of the Board of Directors at the San Marcos County
