RESOLUTION OF THE BOARD OF DIRECTORS
OF THE VALLECITOS WATER DISTRICT
REQUESTING THAT THE BOARD OF SUPERVISORS
OF SAN DIEGO COUNTY APPOINT THE INDIVIDUALS
WHO HAVE FILED DECLARATIONS OF CANDIDACY
TO FILL THE TERMS OF DIRECTOR ENDING IN 2012
WHEREAS, an election of Directors to fill the offices for the terms ending in the
year 2012 of the VALLECITOS WATER DISTRICT was to be held on November 4,
2008; and
WHEREAS, on the eighty-third (83rd) day prior to the election, only one (1)
person had filed a Declaration of Candidacy for the offices of Division 1 (TIMOTHY M.
SHELL), Division 4 (MARGARET E. FERGUSON), and Division 5 (DARRELL W.
GENTRY) for the terms ending in the year 2012; and
WHEREAS, Section 10515 of the Elections Code of the State of California
provides that under the attendant circumstances the Board of Supervisors of San Diego
County shall appoint as Director that person who has filed a Declaration of Candidacy to
fill the offices of Division 1, Division 4, and Division 5 without an election.
NOW, THEREFORE, the Board of Directors of the VALLECITOS WATER
DISTRICT does hereby resolve and order as follows:
Section 1: The Board of Directors finds that the General Election of the
Director of Division 1, Division 4, and Division 5 for the terms ending in the year 2012 is
hereby canceled.
Section 2: The Board of Directors finds that TIMOTHY M. SHELL is the
only person who has filed a Declaration of Candidacy for the office of Director for
Division 1, that MARGARET E. FERGUSON is the only person who has filed a
Declaration of Candidacy for the office of Director for Division 4, and that DARRELL W.
GENTRY is the only person who has filed a Declaration of Candidacy for the office of
Director for Division 5.
Section 3: The Board of Directors hereby requests that the Board of
Supervisors for the County of San Diego, California, pursuant to the provisions of
Elections Code Section 10515, appoint TIMOTHY M. SHELL as Director of Division 1,
MARGARET E. FERGUSON as Director of Division 4, and DARRELL W. GENTRY as
Director of Division 5 of the VALLECITOS WATER DISTRICT for the terms ending in
the year 2012.

Section 4: The Secretary of the VALLECITOS WATER DISTRICT is
directed to deliver forthwith a certified copy of this Resolution to the Registrar of Voters
for the County of San Diego, California, and a certified copy to the Clerk of the Board of
Supervisors for the County of San Diego, California.
Section 5: This Resolution shall be made a part of the minutes of this
meeting.
PASSED, ADOPTED, AND APPROVED by the Board of Directors of the
VALLECITOS WATER DISTRICT at a regular meeting held on September 17, 2008, by
the following vote:
