RESOLUTION OF THE BOARD OF DIRECTORS
OF THE VALLECITOS WATER DISTRICT AUTHORIZING
THE GENERAL MANAGER TO TAKE NECESSARY ACTIONS
RELATING TO EMERGENCY SEWER CONNECTIONS
WHEREAS, California Water Code section 31100 authorizes the Vallecitos
Water District ( "District ") to construct and operate facilities for the collection, treatment,
and disposal of sewage for the District and its inhabitants, and
WHEREAS, circumstances arise when, for health and safety reasons, private
parties are forced to connect to the District's sewer system ( "District Facilities ") due to
the failure of the on -site septic system and or other circumstances requiring an
emergency connection; and
WHEREAS, the Board of Directors deems it in the best interests of the public
served by the District to establish a policy allowing the General Manager to take
necessary actions to connect properties with failing septic systems and or other
circumstances requiring an emergency connection to District facilities; and
WHEREAS, the requirement of annexation of the property to a sewer
improvement district and payment of all applicable Sewer Capital Facility Fees,
Annexation Fees, and inspection and installation fees shall be a requirement of service,
including the execution of a Sewer Service Agreement acknowledging the conditions of
service.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the
Vallecitos Water District as follows:
Section 1: In the event of the failure of a septic system and or other
circumstances requiring an emergency connection, the General Manager is hereby
authorized to take all actions deemed necessary to connect the affected property to the
District's sewer system. Such action may include the condition of annexation of the
property to a sewer improvement district and the entering into of a Sewer Service
Agreement with the property owner which may include a schedule of monthly payments
for fees and charges.
Section 2: A twenty five percent (25 %) deposit of the total for Annexation
Fees, Sewer Capital Facility Fees and inspection and installation fees shall be due and
payable upon execution of the Sewer Service Agreement. In lieu of payment of the
balance of the total fees at the time of connection to the District Facilities, a property
owner shall have the option to pay the District in monthly installments, which shall be
due and payable on the first day of each month and shall be delinquent on the tenth day
of the month. Five and one half percent (5.5 %) Interest per annum shall accrue on the
unpaid balance and the payment term shall not exceed 60 months.

Section 3: This policy shall apply only to properties within the approved
service area of the District and situations where an existing home requires connection
due to failing septic and or other emergency circumstance and does not apply to vacant
land or property under development.
Section 4: The General Manager shall inform the Board of Directors of
instances where it is necessary to take action pursuant to this Resolution and shall
provide the Board with copies of all agreements entered into on behalf of the District.

Vallecitos Water District at a regular meeting held on this 15th day of October, 2014 by
the following roll call votes:
