RESOLUTION OF THE BOARD OF DIRECTORS OF THE SAN
MARCOS COUNTY WATER DISTRICT MAKING APPLICATION
FOR THE ANNEXATION OF TERRITORY TO SAID DISTRICT
AND SEEKING THE APPROVAL OF THE LOCAL AGENCY
FORMATION COMMISSION OF THE COUNTY OF SAN DIEGO
(FRY ANNEXATION)
Whereas, the Board of Directors of the San Marcos County
Water District desires to initiate proceedings for the annexation to
said District of the territory hereinafter described.
NOW THEREFORE, THE BOARD OF DIRECTORS OF THE SAN MARCOS
COUNTY WATER DISTRICT DOES HEREBY RESOLVE, DETERMINE AND ORDER
AS FOLLOWS:
Section 1. Application and a proposal is hereby made to
the local Agency Formation Commission of the County of San Diego for
a change of organization as follows:
A. This proposal is made pursuant to the District Re-
organization Act of 1965 commencing with Section 56000 of the Govern-
ment Code of the State of California.
B. The nature of the porposed change of organization
is proposed are as follows:
1. The annexation of the hereinafter described
territory to the San Marcos County Water District
2. The Bueno Colorado Municipal Water District
3. The Vista Irrigation District
D. The territory proposed to be annexed to the San Marcos
County Water District is uninhabited. A description of the exterior
boundaries of said territory is as follows:
A portion of Lot 1 all of Lots 2, and 3, and a
prtion of Lot 4, all in Block 107, and a portion of
Lot 1, Block 89, both in Rancho Los Vallecitos de San
Marcos , County of San Diego, State of California, more
particularly described as Parcel Nos. 4, 5, 6, 7, 14, and 15 of Assessor's
Map, Book 219, Page 241
It is described that the proposed annexation provide for and
be made subject to the following terms and conditions:
1. The payment to the San Marcos County Water District
of the sum of $2,232.10, due and payable prior to the
effective date of said annexation. Said payment is for
the right of use of all existing property , real and per-
sonal of said District.
2. The payment of all costs of said annexation, in-
cluding but not limited to advertising, engineering, and
attorney's fees.
3. The inclusion of said territory in Improvement
Districts 1,2 and 6 of the San Marcos County Water District.
E. The reasons for this proposal are as follows:
1. The San Marcos County Water District is empowered
to and is engaged in the collections and treatment of sewage
and has existing supplies and facilities for the collection
and treatment of sewage sufficient to provide swwer service
to the territory proposed to be annexed.
2. The San Marcos County Water District is empowered to and is engaged in the supply and distribution
of water
and has existing pipelineand facilities and a supply of
water through the Bueno Colorado Municipal Water District,
the San Diego County Water Authority , and the Metropolitan
Water District of Southern California sufficient to provide
water services to the territory proposed to be annexed.
Section 2. The Secretary of said District is hereby author-
ized and directed to file a certified copy of this resolution with the
executive officer of the Local Agency Formation Commission of the County
of San Diego, State of California, and the Secretary of theDistrict is
hereby authorized and directed to provide to the Local Agency Formation
Commission of the County of San Diego, State of California, such
information and/or maps as may be required by the Local Agency Forma-
tion Commission.
PASSED AND ADOPTED this 15th day of January, 1968, by the
following roll call vote:
