RESOLUTION OF THE BOARD OF DIRECTORS OF SAN MARCOS
COUNTY WATER DISTRICT ORDERING THE ANNEXATION OF
CERTAIN PROPERTY DESIGNATED "THE FRY ANNEXATION"
TO THE SAN MARCOS COUNTY WATER DISTRICT
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE SAN MARCOS
COUNTY WATER DISTRICT AS FOLLOWS:
Section 1: The following facts arc hereby found and determined
to be true'.
(a) That the San Marcos County Water District commenced the
preliminary proceedings for the annexation of the territory described
herein by filing with the Local Agency Formation Commission of the
County of San Diego Resolution 24o. 294 of the Board of Directors of
the San Marcos County Water District, adopted January 13, 1968.
(b) The land described ill said Resolution No. 294 is the land
heroinafter described in this Resolution; that the owners of the land
described in said Resolution 240. 294 have given their written consent
to said annexation.
(c) That the owners of the land described in this Resolution
have advanced to the Secretary of the San Marcos County Water District
the costs of this annexation, including but not limited to adver-
tising, engineering, and attorney'a fees.
(d) Tim inclusion of said land will be for th~ best interests
of the District.
(e) Ti~e inclusion of said land will be for the beat interests
of the land~ and the owners thereof consent to the inclusion of said
land in the District.
If) The Board of Directors determines that all of the land
described in said Resolution No. 294 and hereinafter described shall
be included in the District; that t~e proceedings had for the annexa-
tion and inclusion heroin and above referred to were genuine and
sufficient and in all respects complied with the District Reorgani-
zation Act of 1965, beginning with Section 56000 of the Government
Code of the State of California.
Section 2: Tlx~ Board of Directors of the San Marcos County
Water District does hereby order the annexation of all of the land
described in the Resolution above referred to. The following is
tile legal descriptoon o~ the land included within the San Marcos
County Water District pursuant to this Resolution and the Procecdings
above referred to, which said description is sufficient to identify
the land:
All of those portions of Blocks 86 and 10 and adjacent
streets of Rancho Los Vallecitos de San Marcos, according
to Map 806, filed in the San Diego County Recorder's Office,
lyng within the following described boundary line:
1. Beginning at th~ intersection of the centerline of "F"
Street (Las Flores Drive) and the point of 4th Street
(Linda Vista Drive);
2. thence southesterly along the centerline of "F" Street
Las Flores Drive) to its intersection with the center-
line of lot Street;
3. thence northwesterly, along the centerline of lot Street
to its intersection ',~ith the boundary of th~ Rancho de
Los Vallecitos de San Marcos between Posts No. 15 and 16
as recorded on Map 806, filed in the office of the County
Recorder, San Diego County, 21 December 1895;
4. thence northwesterly along said boundary a distance of
two hundred and twenty (220) feet more or less to its
intersection with the centerline of Road Survey No. 1565,
County of .San Diego;
thence northeasterly along the centerline of said Road
Survey No. 1565 (Linda Vista Drive) to its intersection
with the centerline of 4th Street (Linda Vista Drive);
6. thence southeasterly along the centerline of 4th Street
Linda Vista Drive to the Point of beginning.
Section 3: This Resolution shall become effective immediately
upon its final passage; this Resolution being adopted purstlant to
Section 56322 of the Government Code of the State of California and
pursuant to the Resolution of tile Local Agency Formation Commission
adopted March 5, 1968. This Resolution being adopted l.,lithout notice
and hearing and without an election being conducted in said territory,
all in accordance ~'ith Section S6322 of the Government Code of the
State of California and the Resolution of the Local Agency Formation
Commission as aforesaid. The Secretary of this District shall comply
with the provisions of the government Code, Scction 56450 through
Section 56457, and shall file with the Secretary of State and with
the County Recorder of San Diego County certified copies of this
Resolution and certificates stating that this resolution is effec-
tive. The Secretary of this District shall further comply with t~e
provisions of t~e Government Code, Section 54900, et s~q., by filing
with the State Board of Equalization snd with the County Assessor of
San Diego County statements of change of boundary together with a
map or plat of th~ area to be assessed.
PASSED AND ADOPTED at a regular meeting of th~ Board of Direc-
tors of the San Marcos County Water District held on April 15 1968,
by the following roll call vote:
AYES: Directors Dow, Dutton, Mahr, Vanderbeck and Blanchard
