RESOLUTION OF THE BOARD OF DIRECTORS
OF THE VALLECITOS WATER DISTRICT
AUTHORIZING THE GENERAL MANAGER TO TAKE
NECESSARY ACTION REGARDING SEPTIC SYSTEM FAILURES
WHEREAS, Califomia Water Code section 31100 authorizes the Vallecitos Water District ("District")
to construct and operate facilities for the collection, treatment, and disposal of sewage of the District and its
inhabitants;
WHEREAS, circumstances anse when, for health and safety reasons, private parties are forced to connect
to the District's sewer system due to the failure of the on-site septic system; and
WHEREAS, the Board of Directors deems it in the best interests of the public served by the District to
establish a policy allowing the General Manager to take necessary action to connect properties with failing septic
systems to District facilities in limited circumstances including annexation of the property to a sewer
improvement district.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Vallecitos Water District
as follows:
Section 1: In the event of the failure of a septic system, the General Manager is hereby authorized
to take all actions deemed necessary to connect the affected property to the District' s sewer system. Such action
may include the annexation of the property to a sewer improvement district and the entering into of an agreement
with the property owner which may include a schedule of payments for all fees and charges for annexation and
connection to the District's facilities.
Section 2: Provided, however, this policy shall apply only to situations where fees and charges of
annexation and connection to the District facilities do not exceed $10,000.
Section 3: The General Manager shall inform the Board of Directors of instances where it is
necessary to take action pursuant to this resolution and shall provide the Board with copies of all agreements
entered into on behalf of the District.
PASSED, APPROVED, AND ADOPTED by the Board of Directors of the Vallecitos Water District
at a regular meeting held on this 18th day of October, 1995, by the following roll call votes:
