RESOLUTION OF THE BOARD OF DIRECTORS OF THE
VALLECITOS WATER DISTRICT ORDERING
THE ANNEXATION OF CERTMN PROPERTY DESIGNATED
NORTH COUNTY RESOURCE RECOVERY ASSOCIATES
INTO THE VALLECITOS WATER DISTRICT
AND IMPROVEMENT DISTRICTS 1,2,6 AND
WHEREAS, a petition for the annexation to the Vallecitos Water District
was filed with the Executive Officer of the Local Agency Formation Commission of the
County of San Diego; and
WHEREAS, the Executive Officer of the Local Agency Formation
Commission has examined the petition and determined that it is signed by the requisite
number of signers, and has attached her certificate to the petition showing the results of her
examination, as provided in Government Code Section 56150 through 56162, inclusive; and
WHEREAS, the land described in said petition is the land hereinafter
described in Exhibit "A" attached hereto, and the owners of the land have given their written
consent to said annexation; and
WHEREAS, the owners of the land described in this Resolution have
advanced to the Secretary of the Vallecitos Water District the costs of this annexation,
including, but not limited to, advertising, engineering and attorney's fees; and
WHEREAS, the owners of the land described in this Resolution have
executed an Agreement for Construction; and
WHEREAS, the inclusion of said land will be for the best interest of the
District; and
WHEREAS, the inclusion of the land will be for the best interest of the land,
and the owners thereof consent to the inclusion of said land in the District; and
WHEREAS, the Board of Directors determines that all of the land described
in said petition and hereinafter described shall be included in the District; that the
proceedings had for the annexation and inclusion herein and above referred to were genuine
and sufficient and in all respects complied with the District Reorganization Act of 1965,
beginning with Section 56000 of the Government Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
DIRECTORS OF THE VALLECITOS WATER DISTRICT, as follows:

Section 1: The Board of Directors of the Vallecitus Water District does
hereby order the annexation of all of the land described in the petition above referred to;
Exhibit "A", attached hereto and incorporated herein, is the legal description of the land
included within the Vallecitos Water District pursuant to this Resolution and the
proceedings above referred to, which said description is sufficient to identify this land.
Section 2: The conditions of said annexation are as follows:
Section 2.1: The annexation is for sewer (only) service.
Section 2.2: Annexation of the territory into the existing
Improvement Districts No. 1, 2, 6 and "A" of the Vallecitos Water District.
Section 3: This resolution shall become effective immediately upon its
final passage.
Section 3.1: This resolution is adopted pursuant to Section 56322 of
the Government Code of the State of California and pursuant to Resolution No. DA 92-1
of the Local Agency Formation Commission Adopted August 3, 1992.
Section 3.2: This resolution is adopted without notice or hearing and
without an election being conducted in said territory all in accordance with Section 56322
of the Government Code of the State of California, and the resolution of the Local Agency
Fonnation Commission as aforesaid.
Section 4: The Local Agency Formation Commission shall comply with
the provisions of the Government Code Section 56450 through Section 56457, and shall file
with the Secretary of State and with the County Recorder of San Diego County, certified
copies of this Resolution and certificates stating that this resolution is effective. The
Secretary of the Local Agency Formation Commission shall further comply with the
provisions of the Government Code Section 54900, et seq., by filing with the State Board
of Equalization and with the County Assessor of San Diego. County statements of change
of boundary together with a map or plat of the area to be assessed.

ANNEXATION" TO THE VALLECITOS WATER DISTRICT
All that portion of the northwest quarter of Section 33, Township 12 south, Range 3 west,
San Bemardino Base and Meridian, in the City of San Marcos, County of San Diego, State
of California, according to United States Government Survey, lying within the following
described boundaries:
Beginning at the intersection of the southerly line of the northerly 1,000.00 feet of the east
half of the northwest quarter of said section with the west line of said east half of the
northwest quarter thereof;
1. Thence north 0°05'19'. east, 90.86 feet (record - north 0004'06'' east) along said west
line to the southerly comer of land described in deed to County of San Diego
recorded in the Office of the County Recorder of said county on July 14, 1978 as File
No. 78-294151 of Official Records;
2. Thence leaving said west line along the southwesterly line of said County of San
Diego land, north 35°42'41" west, 389.16 feet (record - north 35°44'18" west, 388.93
feet);
3. Thence continuing along said southwesterly line north 66023'28'' west, 587.78 feet
(record - north 66°24'18" west);
4. Thence north 23035'42" east to a point in the southerly right-of-way line of Road
Survey No. 441, (Questhaven Road), 50.00 feet wide, map on file in the County
Engineer's Office of said county, beini~ also known as County Road A-28;
5. Thence southeasterly, easterly, and northeasterly, along said southerly fight-of-way
line to an intersection with the west line of said east half of the northwest quarter;
6. Thence south 00°05'19" west along said west line to a point distant thereon south
00°0 5'19~- west, 729.91 feet from the northwest comer of said east half of the
northwest quarter;
7. Thence leaving said west line south 35°45'16" east, 334.44 feet to an intersection with
the southerly line of the northerly 1,000.00 feet of said east half of the northwest
quarter of Section 33, said point of intersection being the beginning of a non-tangent
320.00 foot radius curve, concave northeasterly, a radial line bears north 31031'15"
east from said point;

RECOMMENDED STATEMENT OF DETERMINATIONS
PROPOSED AMENDMENT TO THE SPHERE OF INFLUENCE FOR THE
VALLECITOS WATER DISTRICT
"North County Resource Recovery Associates Annexation"
The following statement of determinations is prepared pursuant to Section 56425 of the
Government Code for designation of the area shown on the attached map as an amendment
to the sphere of influence for the Vallecitos Water District.
(1) The present and planned land uses in the area, including agricultural and
open space.
The site is vacant and has been disturbed. It is located adjacent to the San Marcos landfill
and is within the City of San Marcos. The North County Resource Recovery Associates
(NCRRA) have received all required discretionary approvals from the San Marcos and the
County for the operation of a solid waste recycling center. The City has approved a General
Plan Amendment, a rezoning to Solid Waste Management Zone, a conditional use permit,
and a grading permit.
(2) The present and probable need for public facilities and adequacy of public
services which the agency provides or is authorized to provide.

(3) The present Capacity of public facilities and adequacy of public services which
the agency is authorized to provide.
The Vallecitos Water District has adequate capacity at it Meadowlark Reclamation Plant
to serve the waste recycling center. The Vallecitos Water District will require NCRRA to
finance and construct a 6,850 foot sewer line to connect with existing infrastructure.
(4) The existence of any social or economic communities of interest in the area
if the commission determines they are relevant to the agency.
Sbcial and economic communities of interest are not relevant to this action.
