RESOLUTION OF THE BOARD OF DIRECTORS OF THE
VALLECITOS WATER DISTRICT
ORDERING THE DETACHMENT OF CERTAIN PROPERTY
FROM THE VALLECITOS WATER DISTRICT AND
ANNEXING PROPERTY INTO THE
VISTA IRRIGATION DISTRICT
(PARTRIDGE, ERB, MESA REORGANIZATION)
WHEREAS, a petition for the detachment from the Vallecitos Water
District was filed with the Executive Officer of the Local Agency Formation
Commission of the County of San Diego; and
WHEREAS, the Executive Officer of the Local Agency Formation Commission
has examined the petition and determined that it is signed by the requisite
number of signers, and has attached her certificate to the petition showing the
results of her examination, as provided in Government Code Section 56150 through
56162, inclusive; and
WHEREAS, the land described in said petition is the land hereinafter
described in Exhibit "A" attached hereto, and the owners of the land have given
their written consent to said detachment; and
WHEREAS, the owners of the land described in this resolution have
advanced to the Vallecitos Water District the costs of this detachment including,
but not limited to, advertising, engineering, and attorneys' fees; and
WHEREAS, the detachment of the land will be for the best interest of
the land, and the owners thereof consent to the detachment of said land from the
District; and
WHEREAS, the Board of Directors determines that all of the land
described in said petition and hereinafter described shall be excluded from the
District, that the proceedings had for the detachment and inclusion herein and
above referred to were genuine and sufficient and in all respects complied with
the District Reorganization Act of 1965, beginning with Section 56000 of the
Government Code of the State of California;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the
Vallecitos Water District as follows:
SECTION 1: ORDER OF DETACHMENT.
SECTION 1.1: The Board of Directors of the Vallecitos Water
District does hereby order the detachment of the land described in the petition
above referred to. Exhibit "A", attached hereto and incorporated herein, is the
legal description of the land to be detached from the Vallecitos Water District
pursuant to this resolution and the proceedings above referred to, which said
description is sufficient to identify this land.

SECTION 1.2: Pursuant to Section 54774.2 of the Government Code
of the State of California, the Vallecitos Water District does hereby make
application to the Local Agency Formation Commission of the County of San Diego
to detach the property described in Exhibit "A" attached hereto.
SECTION 1.3: The detachment of territory as proposed was
approved by the Local Agency Formation Commission by Resolution R088-21 adopted
December 5, 1988.
SECTION 2: The terms and conditions of said detachment are as
follows:
SECTION 2.1: The boundaries shall be modified to Exhibit "A"
attached hereto.
SECTION 2.2: The annexation into the Vista Irrigation District
and detachment from the Vallecitos Water District shall not become effective
until all proceedings for these jurisdictional changes have been completed.
SECTION 2.3: Payment of $655.64 to the Vallecitos Water
District.
SECTION 2.4: The property owners shall execute an Assignment
and Waiver of Water Rights in favor of Vista Irrigation District covering in
general the right to the delivery of water from the local water supply owned by
Vista Irrigation District, and a Bueno Colorado Municipal Water District
Entitlement document placing water rights on the property.
SECTION 2.5: The subject properties shall be quitclaimed from
the existing Exchange Agreements with Vista Irrigation District.
SECTION 2.6: Sufficient easements shall be provided to
remaining property owners to allow for adequate access to the existing temporary
off-site water meter.
SECTION 3: This resolution shall become effective immediately upon
its final passage.
SECTION 3.1: This resolution is adopted pursuant to Section
56322 of the Government Code of the State of California and pursuant to the
resolution of the Local Agency Formation Commission.
SECTION 3.2: This resolution is adopted without notice or
hearing and without an election being conducted in said territory all in
accordance with Section 56322 of the Government Code of the State of California
and the resolution of the Local Agency Formation Commission as aforesaid.

SECTION 4: The lead agency (Vista Irrigation District) shall forward
certified copies of its resolution ordering the detachment from Vallecitos Water
District and annexation to Vista Irrigation District. The Local Agency Formation
Commission shall comply with the provisions of Government Code Section 56450
through 56457, and shall file with the Secretary of State and with the County
Recorder of San Diego County certified copies of the lead agency's resolution and
certificates stating that this resolution is effective. The Local Agency
Formation Commission shall further comply with the provisions of Government Code
Section 54900, et seq., by filing with the State Board of Equalization and the
County Assessor of San Diego County statements of change of boundary together
with a map or plat of the area to be assessed.
PASSED AND ADOPTED by the Board of Directors of the Vallecitos Water
District at a regular meeting held on this 1st day of October, 1990, by the
following roll call vote:

section 8, Township 11 south, range 3 west, San Diego base and meridian, in the
County of San Diego, State of California, according to United States Government
survey, lying within the following described boundaries:
BEGINNING at the southwest corner of said north half, also being the northwest
corner of County of San Diego tract 4636, according to map thereof No. 12002, filed
in the County Recorder's Office of said County;
1. Thence along the westerly line of said southeast quarter of the northeast
quarter north 0° 22' 35', 453.71 feet;
2. thence leaving said westerly line south 890 46' 16' east, 656.72 feet;
3. thence south 13° 20' east, 466.57 to the southerly line of said north half, also
being the northerly line of said map 12002;
4. thence along said southerly line north g9° 46' 20' west, 768.00 feet to the
point of BEGINNING.
