RESOLUTION OF THE BOARD OF DIRECTORS OF THE
VALLECITOS WATER DISTRICT
FOR COLLECTION OF
SAN DIEGO COUNTY WATER AUTHORITY
CAPACITY CHARGE
WHEREAS, the Board of Directors of the Vallecitos Water District
("District") is required by law to collect the San Diego County Water
Authority's ("Authority") capacity charge; and
WHEREAS, the Authority on July 12, 1990, passed Ordinance No.
90-2 establishing capacity charges to users of water delivered by the
Authority;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the
Vallecitos Water District as follows:
SECTION 1: COLLECTION AND REMITTAL. The Board of Directors of
the Vallecitos Water District does hereby agree to collect the capacity fee
on behalf of the Authority pursuant to the capacity charge schedule as
amended by the Authority from time to time. All fees collected shall be
remitted to the Authority on a quarterly basis on or before the tenth day
of the months of January, April, July, and October of each year.
SECTION 2: RETENTION OF INTEREST. The District shall retain
any interest earned on funds collected prior to payment to the Authority as
reimbursement to the District for costs incurred in collecting the capacity
charge.
SECTION 3: REFUSAL OF WATER SERVICE. The District shall not
provide a water meter to a water user for use of water received from the
Authority until the water user has paid the District the applicable
Authority capacity charge.
SECTION 4: PROTESTS. Any person, corporation, partnership,
public agency, or other entity objecting to any capacity charge of the
Authority shall have the right to file a complaint with the Authority
pursuant to the protest provisions set forth in section 8 of the
Authority~s Ordinance No. 90-2. All complaints shall be filed in writing
at the offices of the Authority, 3211 Fifth Avenue, San Diego, California
92103-5718, before payment of the charge or within ten days after payment
of the charge.
PASSED AND ADOPTED by the Board of Directors of the Vallecitos
Water District at a regular meeting held on this 20th day of August, 1990,
by the following roll call vote:
