RESOLUTION OF THE BOARD OF DIRECTORS OF THE
VALLECITOS WATER DISTRICT ORDERING THE TERRITORY DESIGNATED
AS THE "RICHLAND ESTATES REORGANIZATION" ANNEXED TO THE
VALLECITOS WATER DISTRICT AND THE DETACHMENT FROM THE
VISTA IRRIGATION DISTRICT
APN #218-210-19 AND 218-220-02 (GMMGW, LLC)
WHEREAS, a petition for the annexation to the Vallecitos Water District with
detachment from the Vista Irrigation District was filed with the Executive Officer of the Local
Agency Formation Commission of the County of San Diego: and
WHEREAS, the Executive Officer of the Local Agency Formation Commission has
examined the petition and determined that it is signed by the requisite number of signers,
and has attached his certificate to the petition showing the results of his examination, as
provided in Government Code Section 56150 through 56162, inclusive; and
WHEREAS, the land described in said petition is the land hereinafter described in
Exhibit "A" attached hereto, and the owners of the land have given their written consent to
said annexation; and
WHEREAS, the regular county assessment roll is utilized by this District; and
WHEREAS, the affected territory will/will not be taxed for existing general bonded
indebtedness of this District; and
WHEREAS, the Board of Directors certifies that the determination by the Local
Agency Formation Commission (LAFCO) that this reorganization is exempted by State
CEQA Guidelines Section 15320 from the requirements of CEQA has been reviewed and
considered; and
WHEREAS, while the territory currently is located withing the Vista Irrigation District,
inadequate pressure at the site precludes the provision of water service from that District's
distribution system; and
WHEREAS, because both water and sewer service can be provided by Vallecitos
Water District's systems, representatives from both Districts agree to this reorganization;
and
WHEREAS, the inclusion of the land will be for the best interest of the land, and the
owners thereof consent to the inclusion of said land in the District; and
WHEREAS, the Board of Directors determines that all of the land described in said
petition and hereinafter described shall be included in the District; that the proceedings held
for the annexation and inclusion herein and above referred to were genuine and sufficient

and in all respect complied with the Cortese -Knox Local Government Reorganization Act
of 1985, beginning with Section 56000 of the Government Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
VALLECITOS WATER DISTRICT, finds, determines and orders as follows:
Section 1. The Board of Directors of the Vallecitos Water District does hereby
order the annexation into the Vallecitos Water District and the detachment from Vista
Irrigation District of all the land described in the petition above referred to; Exhibit "A",
attached hereto and incorporated herein, is the legal description of the land included within
the Vallecitos Water District pursuant to this Resolution and the proceedings above referred
to, which said description is sufficient to identify this land.
Section 2. The conditions of said annexation to Vallecitos Water District are as
follows:
Section 2.1: Concurrent annexation into the Vallecitos Water District and
Sewer Improvement Districts 5 & 6.
Section 2.2: Payment of Vallecitos Water District, Sewer Improvement
Districts 5 & 6 annexation fees and State Board of Equalization charges totaling
$165,704.00.
Section 2.3: No connection to the water or sewer main will be allowed until
completion of the annexation to Vallecitos Water District and detachment from Vista
Irrigation District, payment of all annexation fees, and payment of all current fees and
charges.
Section 3. The conditions of detachment from Vista Irrigation District.
Section 3.1: Payment of the VID detachment fee of $14,174.00.
Section 3.2: Payment of the VID administration fee of $590.00.
Section 3.3: Payment of the VID document preparation fee of $50.00 for the
assignment of water rights; and
Section 3.4: Termination of water service to account numbers 9993-730 and
9993-690 without any refund; and
Section 3.5: Execution of assignment of water rights document
Section 4. This resolution shall become effective immediately upon its final
recordation.

Section 4.1 This resolution is adopted pursuant to Section 56322 of the
Government Code of the State of California and pursuant to Resolution No. R098-1 of the
Local Agency Formation Commission Adopted October 5, 1998.
Section 4.2 This resolution is adopted without notice or hearing and without
an election being conducted in said territory all in accordance with Section 56322 of the
Government Code of the State of California, and the resolution of the Local Agency
Formation Commission as aforesaid.
Section 5: The Local Agency Formation Commission shall comply with the
provision of Government Code Section 57203, and shall file with the County Recorder of
San Diego County certified copies of this resolution and certificates stating that this 1
resolution is complete. The Secretary of the Local Agency Formation Commission shall
further comply with the provisions of Government Code Section 57204 by filing with the
State Board of Equalization and with the County Assessor and Auditor of San Diego County
statements of change of boundary together with a map or plat of the area to be assessed.

at a regular meeting held on this 19th day of December, 2001 by the following roll call vote:
