RESOLUTION OF THE BOARD OF DIRECTORS DF THE
SAN MARCOS COUNTY WATER DISTRICT STATING
THE POLICY FOR COLLECTION OF DELINQUENT ASSESSMENTS
WHEREAS, the Board of Directors of the SAN MARCOS COUNTY WATER DISTRICT
has considered the delinquency in collection of assessments levied in
Assessment Districts created by the SAN MARCOS COUNTY WATER DISTRICT and the
establishment of a system for assisting property owners to pay delinquencies
- in assessments; and
WHEREAS, the Board of Directors recognizes the necessity for establishing
effective deliquency collection procedures which will offer effective
protection to the bond holders and avoid the necessity of immediate
foreclosure upon real property.
THEREFORE, THE BOARD OF DIRECTORS OF THE SAN MARCOS COUNTY WATER DISTRICT
DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: The SAN MARCOS COUNTY WATER DISTRICT shall obtain a statement
of delinquencies in assessments as soon as such information is available after
the date set for payment of tax bills, April 1st and December 10th of each
calendar year.
Section 2: Written notice shall be given to all property owners
delinquent in payment of assessments that the District will commence
foreclosure procedures in the event the delinquent assessment is not paid.
Section 3: The notice shall advise the property owner that in the event
the property owner is unable to pay the full amount of the tax bill, the
property owner should meet with a representative of the District to consider
the availability of any alternative method to satisfy the assessment
delinquency satisfactory to the District.
Section 4: The representative of the District shall meet with the
property owner and determine whether direct payment of the assessment
delinquency can be made to the District in order that upon such payment the
tax roll may be corrected to reflect collection of the assessment delinquency.
Section 5: Any proposed agreement shall be presented to the Board of
Directors for approval at the next regular or adjourned meeting of the Board
of Directors following the expiration of a 30-day period after notice has been
given to the property owner.
Section 6: Foreclosure litigation shall be commenced against a property
owner with a delinquent assessment in the event the owner fails to make an
arrangement for payment of the assessment delinquency which is acceptable to
the Board, unless for good cause the Board of Directors shall extend further
time to the property owner to make such arrangement.
