ORDINANCE NO. 2
ORDINANCE OF THE SAN MARCOS COUNTY
MATER DISTRICT 0l3DERINU THE EXCLUSION OF THE
TERRITORY DESCRIBED THEREIN MU THE SAN MARCOS
COUNTY MATER DISTRICT.
WHEREAS, a petition accompanied by a deposit in the amount
of One Hundred (100) Dollars to meet the expense of advertising and
other costs incident to the proceedings for exclusion was filed with
the Secretary of the San Marcos County dater District on the 24th
day of September, 1955, praying for the exclusion of the territory
described in said petition from the San Marcos County dater District,
and
:WHEREAS, the Secretary called a meeting of the Board of
Directors of the San Marcos County Water District on the 10th day
of November, 1955, at the hour of 7:30 o'clock P.M., which date was
net less than twenty-five days, nor more than fifty days from the day
said petition was filed with the Secretary of the District, and
WHEREAS, the Secretary caused a notice of the Hearing on
said petition to be published for two weeks in a newspaper of general
circulation, circulated within the District, and
WHEREAS, said petition duly and regularly came on for hearing
at the time and place specified by the Secretary of the District as
set forth in the notice of Hearing therein, and which plane was the
place at which the regular meetings of the Board of Directors are
held, and
WHEREAS, all land owners and tax payers within the District
who appeared at said Hearing urged the granting of said petition,
and no one appeared to oppose or did oppose the granting of said
petition, and

WHEREAS, evidence both oral and documentary was introduced
at said Hearing by and on behalf of the petitioners, and it appeared
therefrom that said petition was verified and that it was executed
by the owners in fee of landwhich had an assessed valuation with
improvements in excess of one-half of the assessed value of all of
the privately owned land and improvements in the tract proposed to
be included, and that said petition contained a description of the
land proposed to be exoluded, and a statement that the land proposed
to be excluded would not be substantially and directly benefited by
being in the San Marcos County ;later District, or by its continued
inclusion therein, and that the notice of Hearing on said petition
contained the statement that said petition for the exclusion of the
land described therein had been filed the day when the petition was
filed and a statement that said petition would be heard by the Board
of Directors of the San Marcos County `.Tater District and contained the
time and place of said Hearing and that due and regular notice of said
Hearing was duly given, and it appeared from the evidence introduced
at said Hearing that it would be for the best interest of the District
that the lands described therein be excluded from the District.
NO?, THEREFORE, BE IT ORDAINED by the Board of Directors of
the San Marcos County later District as follows:
Section 1. The Board of Directors of the San Marcos County Water
District hereby determines that it is in the best interest
of the District that the lands described in said petition
and hereinafter described in this Ordinance be excluded
from the San Marcos County ;later District.
Section 2. The Board of Directors of the San Marcos County 'Water
District hereby orders the exclusion of the land described
in said petition, which land is specifically described
as follows:

Those portions of the Rancho Los Vallesitos de San Marcos,
in the County of San Diego, State of California, as shown on Yap
thereof No. 808, Records of said County, deseribed as follows:
BEGINNING at the intersection of the Northeasterly prolon-
gation of the Northwesterly line of Lot 3 in Block 5 of said Rancho
with the asnter line of Grand Aoenue as shown on said Map No. 806;
PARCEL 1:
Course No. 1 THENCE Southeasterly along said center line to the
Northeasterly prolongation of the Southeasterly line
of Lot 2 in said Block 5;
Course No. 2 'THENCE Southwesterly along said Northeasterly prolon-
gation, along the Southeasterly line of said Lot 2 and
along the Southwesterly prolongation thereof, to the
center line of the road between said Block 5 and Block
6 of said Rancho as shown on Map No. 808;
Course No. 3 THENCE Northwesterly along said center line, to the
Southeasterly prolongation of the Northwesterly line
of said Lot 3 in Bleck 5;
Course No. 4 THENCE Northeasterly along said Southwesterly prolon-
gation, along said Northwesterly line of said Lot 3
and along the Northeasterly prolongation thereof. to
the point of beginning.

BEGINNING at the salt Northerly corner of Lot 8 in Block 2
of said Rancho:
Course No. 1 THENCE Southeasterly along the Northeasterly lino of
said Lot Soto the Northwesterly line of Lot 4 in said
Block 2;
Course No. 2 THENCE Southeasterly along said lino, to a point distant
therealeng 205.63 feet Northeasterly frost this most
Westerly corner of said Lot 4;
Course No. 3 THENCE Southwesterly 199.63 feet, nor* or loss. to •
point in the Southwesterly lino of said Lot 4 distant
15.00 toot Southeasterly from the said lost Westerly

Course No. 4 THENCE Southeasterly along the Northeasterly lines of
Lots 10 aid 11 in said Block 2, to the Southeasterly
lino of said Lot 11;

westerly line of the Northeasterly Halves of Lots 9,
10, 11 in said Block 2;

easterly line of Lot 3 in said Block 6;

Northeasterly line of Lot 2 in said Block 6 to the
Southeasterly lino of said Lot 2;

Southwestorly prolongation thereof, to the center lino

line of Lot 3 to said Southwesterly line of the North-
easterly Half of said Lot;
Course No. 11 THENCE Northwesterly along the Southwesterly lino of
the Northeasterly Half of Lot 4 in said Block 6 and
along the Northwesterly prolongation thereof, to the
center line of the road lying between said Block 6
and Bleck 9 of said Rancho as shown on said Kap No.
806;
Course No. 12 THENCE Northeasterly along said cantor line and along
the cantor line of the road lying between said Block
6 and Blocks 9, 10, and 11 of said Rancho as shown on
said Nap No. 806, to the Northwesterly prolongation of
the Northeasterly line of Lot 5 in said Block 6;
Course No. 13 THENCE Southeasterly along said Northwesterly prolon-
gation tothe point of beginning.
Section 3. Said lands so excluded shall not be subject to any
tax levy or tax lien for indebtedness on bonds
issued after the effective date of this Ordinance.
Section 4. The Secretary of this District is directed and
instructed to record a certified copy of this
Ordinance in the office of the County Recorder
of San Diego County.
Section 5. This exclusion shall be known and designated as;

Ordered adopted and approved by the Board of Directors
of the San aiarcoa County dater District on November 10th, 1955,
by the following vote, to wit; AYES - Stanley A. Mahr; John L.
Hazeltine; Naos D. Truasell; Boudinot Atterbury; John C. 'yells.

I, Anna D. Charlton, do hereby certify and state that
I am the duly appointed actin, and qualified Secretary of the
San Marcos County Yater District and the Board of Directors
therefor, and that the foregoing copy of Ordinance No. 2 of
the San Marcos County 'Yater District is a true and correct copy
of Ordinance No. 2 which became effective December 10th, 1955,
and that the sage has not been rescinded, amended or repealed.
