Ord 0003Ordinance No. 3 Ordinance Ordering the *** of lands *** in a Petition filed on the 13th day of april, 1956, with the secretary of the san marcos county water district, making the finding required by law in district thereto and making of such inclusion. Be it ordained by the Board of directors of the san marcos county water district as follows: Whereas, land not a part of the dan marcos county water district in the County of san diego may be included in the san marcos county water district pursuant to the provisions of Chapter 2 of part 8 of Division 12 of the Water code of the State of California, and Whereas, a petition consisting of three separate instruments describing a treat of land proposed to be included in the san marcos county water district signed and acknowledged by fourteen persons in the manner required to entitle an instrument to be recoreded, being the majority in number of the holders of title to the trust of land described in said petition and the holder of title to a majority in *** of the land described in said petition, we filed with the secretary of the san marcos county water district on the 13th day of April 1956 , praying that the land described in said petition be included in the District, and Whereas, the signers of said petition did at the time they filed said petition with the secretary of the district advance to said secretary the cost of publishing and mailing of the notice of the hearing required on said petition for inclusion, and Whereas, the secretary, within forty days after the filing of said petition with the secretary, to wit, on April 21, 1956, *** the publi- cation of a notice of the filing of such inclusion petition in the Daily Times-Advocate, a newspaper printed and published in the County of San Diego, (there being no newspaper printed and published in the san marcos county water district), which notice was published once a week for two successive weeks, to wit: on April 21, 1956, and April 28th, 1956, and contained: (a) A statement of the purpose of the petition. (b) A description of the land proposed to be included (c) The time of the hearing on said petition, to wit: 7:30 o'clock p.m. on May 7th, 1956, at Rich-Mar School, San Marcos, being the regular meeting of the Board *** after the giving of said notice would be completed, and (d) An announcement that any persins interested in the proposed inclusion may appear at the office of the Board as the time of the Hearing and file objections in writing showing cause if any they have why the land or any of it should not be included as proposed in the petition, and Whereas, the Secretary within two days after the publication, to wit: April 21, 1956, did mail a copy of said notice to each person who had not signed said petition and to whom any land proposed to be included in the District was assessed on the last **** assessment roll of the County of San Diego at that person's address as it appeared on said roll, and Whereas, the Affidavit of Publication of said notice and the Affidavit of Mailing of said Notice and said Petition have been presented to and filed with the Board, and Whereas, a copy of ordinance No. 7 of the Buena Colorado Municipal Water District **** the property described in the inclusion petition to the Bueno Colorado Municipal Water District , of the San Diego Water Authority and the Metropolitan Water District of California, and a certificate by Irving C. Veall showing the name and address of the persons to whom the propety was assessed that was described in said petition, and Whereas, at the time and place specified in said notice, the Board proceeded to hear the petition and all objections to it prevented in writing and it appearing that the Board has jurisdiction therof, and that no one appeared in oposition thereto or presented any objection in writing, and said Hearing having been closed, NOW THEREFORE, the Board of Directors of the San Marcos County Water District finds that the following are true: (A) Chapter 2 of Part 8 of Division 12 of the County Water District (B) Chapter 2 of Part 8 of Division 12 of the Water Code of California (C) San Marcos County Water District (D) San Marcos County Water District (E) holders of title to the land (F) SECTION i. The Board of Directors of the San Marcos County Water District orders the inclusiono f all of the land described in said petition, which is described as follows: County of San Diego, State of California Section 26, Township 12 South, Range 3 West, S. B.B. & M., September 7, 1889 U.S. Surveyor Gneral's Office, San Francisco, California Bueno Colorado Municipal Water District, 9. West Center line of the Southeast Quarter of Section 27, T. 12 S.,R. 3 W., S.B.B.& M. Bellford Village Water District Carlsbad Municipal Water District 25. Thence North along said North and South center line and the North and South center line of the East half of section 1A of said Township and **** to the East and West center line of Section 16 and 17 of said Township and Range, being also a point on the boundary of the Bueno Colorado Municipal Water District. 26. Thence Ieast along said center line to the center of **** Section 17 being also a point on the **** boundary of the Bueno Colorado Municipal Water District and the San Marcos County Water District. 27. Thence South along said **** boundary and along the North and South center lines of Sections 17 and 20 of said Township and Range to the East and West center line of the North half of Sections 20, 21 and 22 of said Township and Range. 28. Thece East along said East and West center line of the North half of said Sections 20, 21, and 22 to the East line of Section 22. 29. Thence South along said East line and the West line of Section 27 to the True point of Beginning. Section II The President and Secretary are hereby directed and instructed to file with the Secretary of of the State of California, and with the County Recorder of San Diego County, California, certified copies of theis Ordinance and the necessary Certificates stating that no petition for disapproval and rate of this Ordinance was filed within the time provided by law, if such be the fact. SECTION III. That the proper *** of the District be instructed and directed if this Ordinance takes effect to file with the County Assessor of San Diego County and the State Board of Equilization on the necessary maps and statements showing that said property has been *** to the San Marcos County Water District prior to the first day of February, 1957. Section IV. This inclusion shall be known and designated as "San Marcos County Water District - Inclusion No. 1." All that unincorporated territory in the County of San Diego, State of California described as follows: Beginning at the Southwest corner of Section 26, Township 12 South, Range 3 West, S. B. B. & M., according to Township plat thereof dated September 7, 1889, on file in the U. S. Surveyor General's Office, San Francisco, California, being an angle pint on the boundary line of the Buino Colorado Municipal Water District, thence North 1 06 East along the boundary line of said Bueno Colorado Municipal Water District, 971.76 feet to the true point of beginning. 1. Thence leaving said boundary line of Bueno Colorado Municipal Water District S. 73 13 West, 22.63 Feet; 2. Thence on a tangent curve concave Southeasterly radius 300 feet a distance of 124.75 feet; 3. Thence S. 49 degrees 23' 20" West, 206.37 feet; 4. Thence on a tangent curve concave Northerly radius 150 feet a distance of 151.23 feet; 5. Thence n. 72 degrees 50' 30" West, 91.88 feet; 6. Thence on a tangent curve concave Southerly radius 700 feet a distance of 224.69 feet; 7. Thence S. 88 46 West, 71 feet; 8. Thence N. 1degree 06" East 319.83 Feet; 9. Thence N. 59 degree 00' West to the East and West Center line of the Southeast Quarter of Section 27, T. 12S., R. 3 W., S. B.B.& M. 10. Thence West along said centerline of said Southeast Quarter to the North and South Center line of said Section 27; 11. Thence North along said North and South center line to the East and West center line of said Section 27; 12. Thence West along said East and West center line of said Section 27 and continuing along the East and West centerline of Sections 28 and 29, said Twonship and Range to the Northeast corner of the Northwest Quarter of South- east Quarter of said Section 29, being also a point on the boundary of the Bellford Village Water District. 13. Thence along the boundary of said Bellford Village Water district the following courses and distances, South along the Easterly line of said North- west Quarter of Southeast Quarter to the Southeast corner thereof; 14. Thence cast along the North line of the Southeast Quarter of Southeast Quarter of said Section 29 to the Northeast corner of said Quarter Quarter; 15. Thence South along the East line of said Section 29 to the Southeast corner thereof. 16. Thence West along the South line of said Section 29 to the North and South center line thereof; 17. Thence North along said North and South center line to the Southeast corner of the Northeast Quarter of Southwest Quarter of said Section 29; 18. Thence West along the South line of said Quarter Quarter to the South west corner thereof; 19. Thence North along the West line of said Quarter Quarter to the North- west corner thereof; 20. Thence West along the East and West center line of said Sections 29 and 30 of said Township and Range to the Southwest corner of the Southeast Quarter of the Northeast Quarter of said Section 30; 21. Thence North along the West line of said Quarter Quarter to the East and West center line of the North half of said Section 30; 22. Thence West along said center line to the West line of said Section 30 being also a point on the boundary line of the Carlsbad Municipal Water District 23. Thence North along the Range line between Ranges 3 and 4 West and along the boundary of said Carlsbad Municipal Water District to the East and West center line of the South half of Section 19, T. 12 S., R. 3W., S.B.B.& M; 24. Thence East along said East and West center line to the North and South center line of the East half of said Section 19; 25. Thence North along said North and South center line and the North and South center line of the East half of Section 18 of said Township and Range to the East andWest center line of Sections 18 and 17 of said Township and Range, being also a pint on the boundary of the Bueno Colorado Municipal Water District; 26. Thence East along said center lines to the center of fractional Section 17 being also a point on the coterminous boundary of the Bueno Colorado Municipal Water District and the San Marcos County Water District. 27. Thence South along said coterminous boundary and along the North and South center lines of Sections 17 and 20 of said Township and Range to the East and West center line of the North half of Sections 20, 21 and 22 of said Township and Range; 28. Thence East along said East and West center line of the North half of said Sections 20, 21 and 22 to the East line of Section 22; 29. Thence South along said East line and the East line of Section 27 to the True Point of Beginning.
