ORDINANCE NO. 48
AN ORDINANCE OF THE SAN MARCOS COUNTY WATER DISTRICT
PURSUANT TO ARTICLE 2, PART 7, DIVISION 12 (31665 to
31675 INCLUSIVE) OF THE WATER CODE OF THE STATE OF
CALIFORNIA
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE SAN MARCOS
COUNTY WATER DISTRICT AS FOLLOWS:
Section 1: The Board of Directors does hereby find and
determine because of circumstances that may exist in the District,
it is just and reasonable that petitions for special rates of
taxation be heard and determined.
Section 2: Any person having an interest in land may
file with the Secretary a verified petition alleging all of the
following:
(a) His land or a described portion of it was, prior to
the acquisition or establishment by the District of any water system
of waterworks serving the territory in which the land is situated,
irrigated from another system of works than the works of the District.
(b) It has continued ever since to be exclusively so irri-
gated.
(c) It is entitled to a special rate of taxation.
Section 3: Any person or persons petitioning the Board
shall pay, to the Secretary, a fee of $10.00 for each petition. The
money or fee shall be applied to the cost of the publication of the
notice and other expenses of the hearing.
Section 4: The Secretary upon receipt of a petition or
petitions and receipt of the proper fee, shall bring the petition
before the Board of Directors after verifying that said petitions
comply with the provisions of Section 31665 of the Water Code.
