AN ORDINANCE OF THE VALLECITOS WATER DISTRICT
MODIFYING ORDINANCE NO. 65, ARTICLE V, USE OF PUBLIC
SEWERS, ADDING SECTION 1.1, GROUNDWATER REMEDIATION
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE VALLECITOS WATER
DISTRICT AS FOLLOWS:
SECTION 1
Ordinance No. 65, Article V,. USE OF PUBLIC SEWERS; SECTION 1.1
GROUNDWATER REMEDIATION, is hereby added as follows:
SECTION 1.1. GROUNDWATER REMEDIATION. The District shall provide
for groundwater remediation pursuant to the direction of the California
Regional Water Quality control Board, San Diego section in conformance with
the rules and regulations of various government agencies which include, but
are not limited to, the District, Resolution 829; Encina Water Pollution
Control Facility, 40th Supplement to the Encina Basic Agreement; State
Water Resources Control Board; Regional Water Quality Control Board, San
Diego section; State Department of Health Services; San Diego County Health
Department; California Coastal Commission, etc., governing remediation of
groundwater. Availability of short term capacity shall be determined by
both Encina and the District. A successful permit shall not exceed one
year and be subject to any and all terms and conditions. The Board shall
establish a sewer capacity charge in addition to other such fees and
charges established form time to time by the Board of Directors.
This Ordinance shall be in effect immediately upon adoption and
shall be published in a newspaper of general circulation within the
District.
