RESOLUTION OF THE BOARD OF DIRECTORS
OF SAN MARCOS COUNTY WATER DISTRICT,
CALIFORNIA, DETERMINING UNPAID ASSESS-
MENTS AND THE MANNER OF PAYMENT THERE-
OF AND LISTING THE BONDS TO BE ISSUED
ON THE SECURITY THEREOF
Assessment District No. 76-3
WHEREAS, this Board of Directors has taken proceedings under the
Municipal Improvement Act of 1913, Division 12 of the Streets and
Highways Code, and has confirmed an assessment which was recorded on
October 20, 1978, in the office of the Superintendent of Streets; and
WHEREAS, the assessment diagram and notice of the assessment, as
prescribed in Section 3114 of said Code were recorded by the Superinten-
dent of Streets with the County Recorder of San Diego County on
October 20, 1978, whereupon said assessment was attached as a lien upon
the property assessed as provided in Section 3115 of said Code; and
WHEREAS, said proceedings provided that bonds would be issued
pursuant to the Improvement Bond Act of 1915, Division 10 of said Code;
and
WHEREAS, a list of unpaid assessments has been filed in the Office
of the Auditor of the San Marcos County Water District pursuant to
Section 8620 of said Code and the Superintendent of Streets has listed
all of the assessments as unpaid and that the aggregate amount of unpaid
assessments is the amount of $1,213,380.14; and
WHEREAS, the bonds proposed to be issued are 243 in number, are
numbered in consecutive numerical order from 1 to 243, inclusive, beginning
with the earliest maturity, Said bonds are of the denomination of $5,000
each, except that Bond No. 1 is in the amount of $3,380.14. Said bonds
are dated January 2, 1979 and bear interest from their date at a rate or
rates hereafter to be fixed, but not to exceed eight percent (8%) per
annum. The first payment of interest is payable on January 2, 1980, and
thereafter the interest is payable semiannually on July 2 and January 2
of each year. Said bonds shall mature on July 2 in the amounts and years
as follows:

NOW, THEREFORE, the Board of Directors of the San Marcos County
Water District DOES HEREBY FIND, RESOLVE, DETERMINE AND ORDER as follows:
SECTION 1. The unpaid assessments upon the security of which the
bonds are to be issued are determined to be as set forthin the recitals
hereof.
SECTION 2. Said unpaid assessments shall be payable in the manner
provided in Sections 8760 et seq. of the Streets and Highways Code and shall
be payable in the same manner and at the same time and in the same install-
ments as the general taxes of the District on real property are payable.
Pursuant to Section 8761 of said Code, a copy of this resolution and a
copy of the list of unpaid assessments filed in the office of the Auditor
of the District shall be filed in the office of the Auditor of San Diego
County, California. Said Auditor shall enter in his assessment roll on
which taxes will next become due the amount coming due the fiscal year
covered by the applicable assessment roll pursuant to said Sections 8760 et seq.

California, DO HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Board of Directors of said District at a meeting of said
Board of Directors held on the 18th day of December, 1978, and that it was
so adopted by the following vote:
