RESOLUTION OF THE BOARD OF DIRECTORS OF
THE SAN MARCOS COUNTY WATER DISTRICT,
AMENDING AN ASSESSMENT AS CONFIRMED BY
RESOLUTION NO. 488 IN THE MATTER OF ASSESS-
MENT DISTRICT NO. 76-3
WHEREAS, this Board of Directors has by its Resolution No. 488 made certain
determinations, confirmed assessments and proceedings, and ordered proposed
improvements in connection with Assessment No. 76-3; and
WHEREAS, subsequent to the adoption of said Resolution No. 488 and the
filing of the Assessment Diagram and Notice of Assessment and the recordation of
the Assessment Diagram, the Assessment and the Assessment Roll, it was brought
to the attention of the Engineer of Work that one of the properties included
within said Assessment District No. 76-3, to wit: Parcel No. 223-030-43, had
been improperly assessed; and,
WHEREAS, the Engineer of Work has recommended to this Board of Directors
that the assessments confirmed by the said Resolution No. 488 should be amended
to delete any assessment with respect to Parcel No. 223-030-43, and this Board of
Directors wishes to do so,
NOW, THEREFORE, the Board of Directors of the San Marcos County Water District
DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows:
SECTION 1. The amount of the assessment for Assessment District No. 76-3
as set forth in the Final Report referred to in the aforesaid Resolution No. 488
and as confirmed by said Resolution No. 488 hereby is changed from $1,224,524.00
to $1,213,380.14; the amount of the said assessment, as so changed, should be
confirmed; and said assessment is hereby confirmed and rixed in the amount of
$1,213,380.14.
SECTION 2. The amounts to be assessed against the individual parcels
shown in the assessment diagram contained in the aforesaid Final Report hereby
are amended to change the amount to be assessed against Parcel No. 223-030-43
from $11,143.86 to $1.00; the amounts to be assessed against the individual
parcels as shown on the Assessment Diagram contained in said Final Report, as so
changed, are hereby approved and confirmed; and the Secretary of the District is
hereby directed to endorse the fact and date of such amended approval on said
Final Report.

SECTION 3. The Secretary of the District is hereby directed to file
and record the said diagram and assessment, as so changed, as required by
Sections 3104 and 10401 of the California State and Highways Code; and the
Engineer shall record a Notice of Assessment and give notice of the recordation
of said assessment to the owner of Parcel No. 223-030-43 as required by
Sections 3114 and 10404 of said Code.
SECTION 4. The Engineer is hereby instructed to record said assessment
and digram, as so changed, in his office pursuant to Section 10401 of the Streets
and Highways Code and to give notice to the owner of Parcel No. 223-030-43, as
provided for in Section 10600 of said Code.
