RESOLUTION OF THE BOARD OF DIRECTORS OF THE SAN MARCOS
COUNTY WATER DISTRICT INTERPRETING PROVISIONS OF ORDINANCE
NO. 60 CONCERNING SEWER CONNECTION FEES AND DISTRICT
CONNECTION ALLOCATION POLICY FOR PROJECTS
WHEREAS, the District adopted Ordinance No. 60 establish-
ing sewer connection fees and a District connection allocation
policy for projects.
WHEREAS, paragraph 4.5 (page 3) provides in part that:
"Acceptance on an allocation list will be for that applicant
and is not transferable to another individual, group of persons,..."
WHEREAS, the financing of projects in some cases requires
that the applicant provide the individual or institution furnish-
ing the financing with security in the form of naming the lending
individual or institution in the title documents.
WHEREAS, the Board of Directors does not deem this to be
a violation of the terms or policy of the foregoing provisions
of Ordinance No. 60 which is designed primarly to prevent
_ speculation and development of a secondary market in sewer
connections.
NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE SAN MARCOS
COUNTY WATER DISTRICT DOES HEREBY FIND, DETERMINE, ORDER AND
RESOLVE AS FOLLOWS:
Section 1: The naming of a Lendor, individual or in-
stitution, in the title documents of a particular property in
addition to the particular applicant is not precluded or pro-
hibited by Section 4.5 (page 3) of Ordinance No. 60, and the add-
ition of such a named individual or institution shall not be
deemed a transfer "to another individual [or] group of persons,..."
Section 2: The stall of the San Marcos County Water
District is hereby authorized and directed to administer
Ordinance No. 60 in accordance with the interpretation set
forth in this resolution.

THE SAN MARCOS COUNTY WATER DISTRICT THIS 17th day of September,
