RESOLUTION OF THE BOARD OF DIRECTORS OF THE
SAN MARCOS COUNTY WATER DISTRICT
MAKING APPLICATION TO BECOME A SEPARATE UNIT
OF THE SAN DIEGO COUNTY WATER AUTHORITY
WHEREAS, the San Marcos County Water District has previously requested
separate unit status in the San Diego County Water Authority and consent for
detachment from the Bueno Colorado Municipal Water District; and
WHEREAS, the County Water Authority and the Bueno Colorado Municipal
Water District have previously agreed in principal to the request by the San
Marcos County Water District, subject to conditions relative to the elimination
of certain territorial and jurisdictional overlaps between the San Marcos County
Water District and the Vista Irrigation District; and
WHEREAS, said aforementioned conditions were met in part by the ratifi-
cation by the San Marcos County Water District, the Bueno Colorado Municipal Water
District and the Vista Irrigation District of a "Memorandum of Understanding"
relative to future boundary adjustments; and
WHEREAS, the remainder of said aforementioned conditions will be met
in full by the approval by the Local Agency Formation Commission of the proposed
"Bueno Colorado Reorganization"; and
WHEREAS, legislation was introduced (Senate Bill 141 Craven) and
enacted into law (Chapter 22, Statutes of 1979) providing the authority and
procedure by which the San Marcos County Water District may become a separate
unit of the San Diego County Water Authority.
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the San
Marcos County Water District, pursuant to Section 10.3 of the Water Code Appendix,
hereby applies to the Board of Directors of the San Diego County Water Authority
for its consent to the following:
1. That certain territory of the San Marcos County Water
District be detached from the Bueno Colorado Municipal
Water District; and
2. That the San Marcos County Water District become a
separate unit of the San Diego County Water Authority.
BE IT FURTHER RESOLVED, that the Secretary be directed to file a
certified copy of this Resolution with the Board of Directors of the San Diego
County Water Authority.
