RESOLUTION OF THE BOARD OF DIRECTORS OF
THE SAN MARCOS COUNTY WATER DISTRICT
ESTABLISHING APPROPRIATIONS LIMIT FOR
THE 1980-81 FISCAL YEAR
WHEREAS, effective July 1, 1980, Article XIII B of the California
Constitution took effect limiting the appropriations of certain state and
local agencies; and
WHEREAS, the Legislature has adopted Government Code sections
7900-13 setting forth procedures to be followed by affected local agencies
in fixing and determining their appropriations limits; and
WHEREAS, pursuant to said Government Code sections, the Department
of Finance has supplied the District with data regarding changes in popula-
tion, cost of living and per capita income for use in determining its appro-
priations limit; and
WHEREAS, the District had a tax rate in excess of 12.5 cents per
$100 of assessed valuation during the 1977-78 fiscal year, and, therefore,
is subject to the provisions of Article XIII B and implementing legislation;
and
WHEREAS, Government Code section 7910 requires that each year the
governing body of the District, by resolution, establish its appropriations
limit for the following fiscal year; however, the section did not take effect
until January 1, 1981, and the necessary information was not supplied to the
District by the Department of Finance until after May 1, 1981, thereby pre-
cluding adoption of this resolution prior to the commencement of the 1980-81
fiscal year; and
WHEREAS, at least 15 days prior to the meeting at which this reso-
lution was adopted, the documentation used in the determination of the appro-
priations limit was made available to the public at the offices of the
District;
WHEREAS, the board has fully considered said laws, the revenues and
expenditures of the District during the relevant years, the data received
from the Department of Finance, the reports and recommendations of staff, and
the opinions of counsel; and

NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED by
the Board of Directors of San Marcos County Water District as follows:
1. That the foregoing facts are true and correct.
2. That pursuant to Article XIII B and section 7910 of the
Government Code, the appropriations limit for San Marcos County Water District
for the 1980-81 fiscal year is established as $50,189.00.
PASSED AND ADOPTED at a regular meeting of the Board of Directors
of San Marcos County Water District held on the 15th day of June, 1981, by
the following vote to wit:
