RESOLUTION OF THE BOARD OF DIRECTORS OF THE
SAN MARCOS COUNTY WATER DISTRICT
ESTABLISHING A POLICY FOR ANNEXATION OF
PROPERTY INTO IMPROVEMENT DISTRICT "A"
WHEREAS, Improvement District "A" was established by
Resolution No. 356 on the 15th day of May, 1972 for sewer
service purposes; and
WHEREAS, the Board of Directors desires to establish
a policy to clarify the circumstances for annexation into
improvement District "A" for sewer service purposes; and
WHEREAS, by Minute Action 86-11-13, the Board of
Directors outlined the basis of the policy respecting
annexations into Improvement District "A" and directed that
this policy be incorporated into a Resolution of the Board.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
DIRECTORS OF THE SAN MARCOS COUNTY WATER DISTRICT as follows:
Section 1: That annexations to Improvement District
"A" for sewer service only will be allowed in the following
circumstances:
A. When a failing wastewater disposal system
creates a health and/or safety problem; or
B. When the District does not have facilities
available for concurrent water service to the property.
Facilities Available" shall mean that reasonable capacities
and proximity are available as determined by the Board. The
annexation of said lands shall not adversely effect existing
customers.
Section 3: Improvement District "A" shall be
relieved of the burden for any tax rate established for the
purpose of water service debt.
Section 4: This Resolution shall be in effect
immediately upon adoption.
