RESOLUTION OF THE BOARD OF DIRECTORS OF THE
SAN MARCOS COUNTY WATER DISTRICT ESTABLISHING
A POLICY WITH RESPECT TO REQUIREMENTS FOR
"CLEAN-OUTS" AND MAINTENANCE OF "SEWER LATERALS"
WHEREAS, the Board of Directors of the San Marcos County
Water District has heretofore determined the necessity for the
District to reconsider existing policy with respect to requirements
for property line "clean-outs" and maintenance of sewer laterals;
and
WHEREAS, the Board of Directors adopted Resolution No. 357
declaring the intention to reconsider a change in policy with respect
to requirements for "clean-outs" and maintenance of sewer laterals
and fixing the time and place of a hearing and giving notice of hearing;
WHEREAS, RESOLUTION NO. 357 and NOTICE OF HEARING was duly
published in the Vista Press, a newspaper of general circulation with-
in the County within which this District is situated on June 23, 1972;
and
WHEREAS, the Secretary has caused said notice, with a copy
of said resolution attached, to be posted in five (5) conspicuous
places within the District at least ten (10) days prior to the hearing;
and
WHEREAS, the Hearing on this matter was duly held by the
Board of Directors at the regular meeting of the Board held on Monday
July 17, 1972, at 3:00 o'clock p.m. at the meeting place of the Board;
and
WHEREAS, all persons interested in the foregoing policy
were accorded an opportunity to appear at said hearing and to be heard;
NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE SAN MARCOS
COUNTY WATER DISTRICT DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
Section 1: The following policy is hereby established with
respect to sewer service provided by the District:

1. The District shall not maintain the sewer lateral
between the street main and the property line; the property owner
serviced by a sewer lateral shall be responsible for the maintenance
of that sewer lateral, and
2. Except for sewer service provided within Improvement
District No. "A", there shall be no requirement for a property line
"clean-out". Within Improvement District No. "A", the District shall
require a property line clean-out"
Section 2: This Resolution shall be in full force and
effect on September 19, 1972.
Section 3: A copy of this Resolution shall be provided to
each sewer service customer of the District and any such sewer service
customer may appear before the Board at the regular meeting of the
Board of Directors to be held at 3:00 o'clock p.m. on September 18,
1972, at the meeting place of the Board, 788 West Encinitas Road,
San Marcos, California 92069, in said District at which such time the
Board will hear any protest to the policy established by this Resolution.
