RESOLUTION OF THE BOARD OF DIRECTORS OF THE
SAN MARCOS COUNTY WATER DISTRICT ELECTING
TO FIX THE DISTRICT RATES OF TAXATION.
WHEt~AS, Section 31702.1 of the Water Code of the State of
California provides that the Board of Directors of a County Water
District may, by resolution, elect to fix its own rate of taxation
and upon filing certified copies of such resolution with the appro-
priate county officials will thereafter continue to fix its own
rate of taxation until it has filed with such officers certified
copies of a resolution electing to the contrary;
WHEREAS, Section 31702.2 of the Water Code of the State of
California provides that following such election by the Board of
Directors of a County Water District, the county auditors shall,
before the third Monday of August of each year, transmit to the
Board a written statement showing the total value of all taxable
property of the District, which shall be used by the County for
taxation for that year.
WHEREAS, Section 31702.3 of the Water Code of the State of
California provides that on or before September 1 of each year, the
Board of Directors shall fix the rates of taxation in not exceeding
four decimals, which are required for each of its purposes for said
year, making due allowance for delinquency as fixed by law or by the
Board, and immediately certify said rates to the County Auditor and
that such acts by the Board of Directors are a valid assessment of
the property and a valid levy of the taxes so fixed;
WHEREAS, Section 31702.4 of the Water Code of the State of
California provides that the County Auditor, upon receipt of the
tax rates established by the Board of Directors of a Water District,
shall compute and enter in the county assessment roll the respective
sums to be paid as a district tax on the property in the District,
using the rate of levy as fixed by the Board of Directors and the
assessed value of the land as found on the assessment roll;

NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE SAN MARCOS
COUNTY WATER DISTRICT DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE
AS FOLLOWS:
Section 1: The Board of Directors of the SAN MARCOS COUNTY
WATER DISTRICT does hereby elect to fix the rates of taxation within
the District.
Section 2: The Secretary of the District is hereby authorized
and directed to file a certified copy of this resolution with the
County Auditor, the County Tax Assessor and the Clerk of the Board
of Supervisors of the County of San Diego on or before July 1, 1976.
Section 3: The Board of Directors of the SAN MARCOS COUNTY
WATER DISTRICT shall continue to fix its own rate of taxation until
it has filed with the county officers innumerated in Section 2
certified copies of a resolution of the Board of Directors of the
SAN MARCOS COUNTY WATER DISTRICT electing to the contrary.
PASSED, ADOPTED AND APPROVED at a regular meeting of the
Board of Directors on the 19th day of April, 1976, by the following
roll call vote:
