RESOLUTION OF THE BOARD OF DIRECTORS OF THE SAN
MARCOS COUNTY WATER DISTRICT ORDERING THE ANNEX-
ATION OF CERTAIN PROPERTY DESIGNATED THE "READ C.
MILLER ANNEXATION" INTO SAN MARCOS COUNTY WATER
DISTRICT
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE SAN MARCOS
COUNTY WATER DISTRICT AS FOLLOWS:
Section 1: The following facts are hereby found and deter-
mined to be true:
(a) That the San Marcos County Water District owns,
operates, and maintains a water distribution system under and by
virtue of the law as set forth commencing at Section 30000 of the
Water Code of the State of California.
(b) That the owner of the land described in this Res-
olution has given his written consent to the annexation of said lands
to the San Marcos County Water District and has, in writing, requested
the annexation of said lands to said District.
(c) That the owner of the land described in this Resolu-
tion has advanced to the Secretary of the San Marcos County Water
District the costs of this annexation, including, but not limited to
advertising, engineering and attorney's fees.
(d) That inclusion of said land to the District will be
for the best interests of the District.
(e) The inclusion of said land within said District will
be for the best interests of the land, and the owner thereof consents
to the inclusion of said land in the San Marcos County Water District.
(f) The Board of Directors determines that all of the
land hereinafter described shall be included in the San Marcos County
Water District; that the proceedings had for the annexation and inclu-
sion herein were genuine and sufficient and in all respects complied
with the District Reorganization Act of 1965 commencing at Section
56000 Of the Government Code of the State of California.
(g) The Local Agency Formation, by Resolution dated
August 5, 1974, approved this annexation and authorized annexation
without notice and hearing and without an election pursuant to

Government Code Section 56261.
Section 2: The Board of Directors of the San Marcos
County Water District does hereby order the annexation of all of
the land hereinafter described to the San Marcos County Water Dis-
trict. The legal description of the land included within the San
Marcos County Water District pursuant to this Resolution is attached
hereto marked Exhibit "A" and made a part hereof.
Section 3: The conditions of the said annexation are as
follows:
(a) Payment by the owner of the Territory to be annexed
to the San Marcos County Water District of the sum of $25.00 per
acre or fraction thereof as an annexation fee.
(b) Payment by the owner of the Territory to be annexed
to said District of all costs of processing the annexation including
but not limited to attorney's fees and engineering and administrative
costs.
(c) The lands annexed to the District shall be subject
to existing bond issues and indebetedness of the District from and
after the filing with the San Diego County Assessor of a certified
copy of this resolution, as set forth in Section 32553 of the Water
Code of the State of California.
Section 4: This Resolution shall be effective upon filing
with the Secretary of State. Govt. C. 56456.
This Resolution is adobted without notice and hearing and
without an election being conducted in said Territory pursuant to
the Resolution of the Local Agency Formation Commission and the pro-
visions of Section 56261 and 56322 of the Government Code of the
State of California.
The Secretary of this District shall comply with the
provisions of Section 54900, et. seq., and 56450 et. seq., of the
Government Code, and shall file by returnable copy a certified copy
of this Resolution together with a map of the territory annexed and

All that portion of Lots 1 and 2, Block M of Charles Victor Hall
Tract, Unit No. 2, in the County of San Diego, State of California,
-- according to Map thereof No. 2056, on file in the Office of the
Recorder of said County, described as follows:
Beginning at a point on the Easterly line of said Lot 2, distant
thereon North 0°35'48" West 532.17 feet from the Southeast corner
thereof; thence North 68°19'02" West 347.24 feet; thence South
11°39'36'' West 131.87 feet; thence North 89~51'34'' East 349.32 feet
to the POINT OF BEGINNING.

Certificate of Completion with the Secretary of State and shall file
counterparts of the foregoing documents, together with counterparts
or copies, as appropriate, of the Certificate of Filing received
from the Secretary of State, with the State Board of Equalization
and With the County of San Diego, the Recorder, for recordation and
return to the District, the Treasurer, the Clerk, the Tax Collector,
the Assessor, the Registrar of Voters, and the Board of Supervisors.
PASSED AND ADOPTED this 19th day of August, 1974, by the
following roll call vote:
