RESOLUTION OF THE BOARD OF DIRECTORS OF THE
SAN MARCOS COUNTY WATER DISTRICT REQUESTING
TERMS AND CONDITIONS FOR THE DISSOLUTION OF
BELLFORD VILLAGE WATER DISTRICT
WHEREAS, the Board of Directors of the San Marcos County Water District
has advised that landowners within the Bellford Village Water District, a land-
owner-voter district, propose to petition for dissolution of the Bellford Village
Water District by reason of inactivity pursuant to Section 56174 of the Government
Code of the State of California; and
WHEREAS, the Board of Directors of the San Marcos County Water District
desires to express approval of the proposed dissolution of the Bellford Village
Water District subject to terms and conditions as described herein, pursuant to
California Government Code Section 56000 et seq. in general and Sections 56474
and 56275 in particular.
NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE SAN MARCOS COUNTY WATER
DISTRICT DOES HEREBY FIND, DETERMINE, RESOLVE AND ORDER as follows:
Section 1: The Board of Directors of the San Marcos County Water
District desires that the Local Agency Formation Commissi on approve the dissoluti on
of the Bellford Village Water District subject to the terms and conditions set
forth herein.
Section 2: The Board of Directors of the San Marcos County Water
District establishes the following terms and conditions for dissolution of the
Bellford Village Water District:
2.1 The effective date of the dissolution shall be September 15,
1978, if all proceedings necessary to said dissolution are completed before this
date. If said proceedings are completed after said date but before December 31,
197S, the effective date of said dissolution shall be December 31, 1978.
2.2 Upon and after the effective date:
2.2.1 Bellford Village Water District, the boundaries
of which are described in Exhibit "A" attached hereto, shall be
dissolved, terminated, disincorporated and extinguished, its existence
shall be terminated and all of its corporated powers shall cease.
2.2.2 The office of the Board of Directors of Bellford
Village Water District shall be terminated.

2.3 Upon the effective date of said dissolution, San Marcos
County Water District shall be the successor to Bellford Village Water District
for the purposes of succeeding to and becoming responsible for all rights, duties,
liabilities and obligations of Bellford Village Water District with respect to
enforcement, performance and payment of all contracts and other obligations of
Bellford Village Water District, other than liabilities for principal and interest
upon general obligation bonds of Bellford Village Water District.
2.4 Upon the effective date of said dissolution, San Marcos
County Water District shall succeed to the title of and shall acquire any and
all moneys, funds (including cash on hand and moneys due but uncollected) and all
other obligations due Bellford Village Water District.
2.5 Upon the effective date of said dissolution, San Marcos
County Water District shall succeed to the title of and shall acquire any and all
properties, real or personal, of Bellford Village Water District.
2.6 Existing assets of Bellford Village Water District, includ-
ing cash on hand and moneys due but uncollected, and all property, real or personal,
acquired by San Marcos County Water District shall be used for the exclusive benefit
of the territory described in Exhibit "A". Any cash on hand, moneys, funds or
other current assets of Bellford Village Water District acquired by San Marcos
County Water District shall be used, in the first instance, to pay the principal
and interest on the outstanding general obligation bonds of Bellford Village Water
District as they become due and payable. Any remaining cash on hand, moneys,
funds or other current assets shall be used for the construction of capital improve-
ments within the territory described in Exhibit "A".
2.7 San Marcos County Water District shall continue to perform
the obligations imposed upon it by the certain Agreement for Acquisition of Pipe-
lines between Bellford Village Water District and San Marcos County Water District
dated October 7, 1957, except that any funds that would otherwise be payable there-
under by San Marcod County Water District to Bellford Village Water District shall
be used for the purposes set forth in subparagraph 2.6 above and for administrative
costs related to the territory described in Exhibit "A".

2.8 San Marcos County Water District may issue and sell any
authorized but unissued bonds of Bellford Village Water District, and if
such bonds are issued and sold, the proceeds shall be used for the consturction
of capital improvements within and for the exclusive benefit of the territory
descrived in Exhibit "A".
2.9 Since Bellford Village Water District is a California Water
District, its power to levy assessments is li mi ted to the levying of assessments
on land only, to provide San Marcos County Water District with the same power to
levy assessments on land described in Exhibit "A", San Marcos County Water District
shall have the power and may levy assessments for the following purposes:
2.9.1 To pay the principal and interest on outstanding
general obligation bonds of Bellford Village Water District not other-
wise paid as provided for in paragraph 2.6 hereof;
2.9.2 To pay the principal and interest on any bonds that
may be issued pursuant to prargraph 2.8 hereof; and
2.9.3 To pay any liabilities of Bellford Village Water
District established by a judgment of a court of competent jurisdiction
entered after the effective date of said dissolution.
2.10 Any such assessment (see Para. 2.9, supra) shall be levied
in the following manner.
2.10.1 The County of San Diego shall maintain a tax rate
area to coincide with the boundaries which are described in Exhibit "A".
Said tax rate area shall continue until June 30, 1985, or until such
date as all principal and interest on the outstanding general obliga-
tion bonds of Bellford Village Water District, and of such bonds as may
be issued and sold pursuant to paragraph 2.8 hereof, have been paid,
whichever date is later in time.
2.10.2 At the time and in the manner provided in the
California Water District Law (Water Code 34000 et seq.), San Marcos
County Water District annually shall provide the County of San Diego
with an estimate in writing of the amount of money needed to be raised
by assessment for the purposes set forth in paragraph 2.9 hereof.

2.10.3 The County of San Diego annually at the time of
levying County taxes shall levy an ad valorem assessment upon all lands
within the boundaries described in Exhibit "A" to raise the amount so
estimated by San Marcos County Water District. Said ad avlorem assess-
ment shall be levied and collected by the County of San Diego at the
same time and in the same manner it collects ad valorem assessments for
California Water Districts.
2.10.4 Moneys collected by the aforesaid assessment on
land only shall be transmitted by the County of San Diego to San
Marcos County Water District, and San Marcos County Water District shall
use said moneys only for the purposes set forth in paragraph 2.9 hereof.
2.11 Upon the effective date of said dissolution, that portion
of the territory of Bellford Village Water District described in Exhibit "B"
shall be annexed to Improvement Districts Number l, Number 2 and Number 4 of the
Carlsbad Municipal Water District and shall be thereafter liable for such taxes,
assessments, service charges, rentals, or rates as may be necessary to provide
payment for any obligations of said improvement districts.
2.12 Upon and after the effective date of said dissolution, that
portion of the territory of Bellford Village Water District not described in Ex-
hibit "B" shall be exempt from any liability for payment of all or any part of
principal, interest and any other amounts which shall become due on account of
all or any part of any outstanding or then authorized but thereafter issued bonds,
including revenue bonds, or other contracts or obligations of Bellford Village
Water District.
2.13 All property and funds of Bellford Village Water District
shall be transferred to San Marcos County Water District without restrictions,
and any "remaining assets" of Bellford Village Water District, as said terms are
used in Sections 56506 and 56507 of the Government Code, shall be retained by
San Marcos County Water District and shall not be distributed as provided in said
sections.
2.14 All standard processing fees and charges imposed by the
Local Agency Formation Commission and the Baord of Equalization shall be shared
as follows:

one-third by the Bellford Village Water District;one-third by the San Marcos
County Water District; one-third by the Carlsbad Municipal Water District. All
special processing fees and costs (e.g., legal, consulting, engineering, etc.)
shall be paid by the San Marcos County Water District from acquired Bellford
Village Water District funds.
2.15 The Board of Directors shall~authorize the Board of
Supervisors to conduct proceedings in accordance with this resolution, without
notice and hearing, and without an election.
Section 3: The Secretary of the District is hereby authorized and
directed to furnish a certified copy of this Resolution to the Local Agency
Formation Commission.
