RESOLUTION OF THE BOARD OF DIRECTORS OF
THE SAN MARCOS COUNTY WATER DISTRICT
ORDERING THE DETACHMENT OF CERTAIN TERRITORY
DESIGNATED THE "ESCONDIDO BY-PASS DETACHMENT"
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE SAN MARCOS
COUNTY WATER DISTRICT AS FOLLOWS:
SECTION 1: The following facts are hereby found and deter-
mined to be true:
(a) The Rincon Del Diablo Municipal Water District commenced
preliminary proceedings for the detachment of territory descirbed herein
by filing with the Local Agency Formation Commission of the County of
San Diego Resolution No. 480 adopted by the Board of Directors on
October 18, 1977
(b) The territory to be detached is described in Exhibit B
attached hereto and made part of this Resolution
(c) All of the owners of land described in Exhibit B have
given written consent to detachment
(d) The detachment of said territory will be for the best
interest of the District, the land and the owners thereof
(e) The Board of Directors determines that all of the
territory described in Exhibit B shall be excluded from the District;
that the proceedings were genuine and sufficient and in all respects
complied with the District Reorganization Act of 1965 (commencing with
Section 56000 of the Government Code of the State of California)
(f) The detachment of territory as proposed was approved
by the Local Agency Formation Commission by Resolution (Ref DD 77-50)
adopted December 5, 1977 (item 11)
SECTION 2: The Board of Directors of the San Marcos County
Water District does hereby order the detachment of all territory
described in Exhibit B
SECTION 3: The terms and conditions of said detachment are
as follows:

1. The description of the boundaries have been modified
to conform to Exhibit B of the Resolution of the Local
Agency Formation Commission (Ref DD 77-50)
2. The detachment of territory from the San Marcos County
Water District shall not become effective until proceedings
have been completed for the annexation of said territory
to the Rincon Del Diablo Municipal Water District.
SECTION 4: This resolution shall become effective immed-
iately upon its adoption; it is adopted pursuant to Section 56322
of the Government Code and aforesaid Resolution of the Local Agency
Formation Commission authorizing the initiation of proceedings without
notice and hearing and without an election.
By certified copy of this Resolution the Executive Officer
of the Local Agency Formation Commission is requested to complete
proceedings and make the necessary filings required by law.
PASSED, ADOPTED AND APPROVED this 19th day of December 1977,
by the following roll call vote:
