RESOLUTION OF THE BOARD OF DIRECTORS OF THE SAN
MARCOS COUNTY WATER DISTRICT ORDERING ANNEXATION
OF CERTAIN TERRITORY DESIGNATED THE "ESCONDIDO
BY-PASS ANNEXATION"
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE SAN MARCOS
COUNTY WATER DISTRICT AS FOLLOWS:
SECTION 1: The following facts are hereby found and deter-
mined to be true:
(a) The Rincon Del Diablo Municipal Water District commenced
preliminary proceedings for the annexation of territory described herein
by filing with the Local Agency Formation Commission of the County of
San Diego Resolution No. 477 adopted by the Board of Directors on
October 18, 1977
(b) The territory to be annexed is described in Exhibit C
attached hereto and made part of this resolution
(c) All of the owners of land described in Exhibit C have
given written consent to annexation
(d) The annexation of said territory will be for the best
interest of the District, the land and the owners thereof;
(e) The Board of Directors determines that all of the
territory described in Exhibit C shall be included in the District;
that the proceedings were genuine and sufficient and in all respects
complied with the District Reorganization Act of 1965 (commencing with
Section 56000 of the Government Code of the State of California).
(f) The annexation of territory as proposed was approved
by the Local Agency Formation Commission by Resolution (Ref. DA 77-120)
adopted December 5, 1977 (item 8);
SECTION 2: The Board of Directors of the San Marcos County
Water District does hereby order the annexation of all the territory
described in Exhibit C.
SECTION 3: The terms and conditions of said annexation are
as follows:

The description of the boundaries have been
modified to conform to Exhibit C of the
Resolution of the Local Agency Formation
Commission (Ref. DA 77-120).
SECTION 4: This Resolution shall become effective immediately
upon its adoption; it is adopted pursuant to Section 56322 of the
Government Code and aforesaid Resolution of the Local Agency Forma-
tion Commission authorizing the initiation of proceedings without
notice and hearing and without an election.
By certified copy of this Resolution the Executive Officer
of the Local Agency Formation Commission is requested to complete
proceedings and make the necessary filings required by law.
PASSED, ADOPTED AND APPROVED this 19th day of December 1977,
by the following roll call vote:
